Service in warranty period

I have purchased Hond Activa Scooter on 17th 2007 from M/s. Delta Automobiles Pvt Ltd Kolhapur, State: Maharashtra.

My sixth free servicing is over 15/09/08. Then after some days I came to know that there is a leakage from gearbox housing. Then I gave my vehicle for repairing at your Delta Automobiles Pvt. Ltd. on 17/12. But I shocked by their service as mentioned below.

They have charged service charge on a/c of gear box overall purpose.

Let me know how they can charge this service charge though my scooter is in warranty period.

Please clarify, otherwise I will launch this complaint in consumer court.
