Malfunctionin of set and company refusing to honour warranty

Dear Sirs,
Re: Complaint about mobile NOKIA 5310 IMEI No. 356870023329085
I purchased the above mobile on 1.2.09 vide Invoice No. R/12925 from Range Tele services, Lajpat Nagar II, New Delhi.
For the last few days, the mobile has developed the following faults:
· Screen when opened develops scratch marks in LCD display
· Battery needs recharging two to three times in a day while the usage time is hardly 20-25 minutes in a day.
· No speaker sound (No beep, No songs)
· When in use for about five minutes continuously the mobile heats up.
On 26.9.09 when I took the set to your micro service centre at Kalkaji, New Delhi, I was orally told that the screen is damaged and needs replacement and asked me to pay about Rs 1600/-. He could not show me any physical damage marks or even a scratch either on the screen or the mobile set. He simply told me that the screen is broken (as it is LCD phone the screen gets broken while kept in pocket). He further told me that till the screen is changed (after payment by me) he would not set right any of the other defects. When no such warning about the screen is given in the brochure how will the customer know about its fragility? He replied that for this you talk to the company and gave me this E-mail Address. He further refused to give any telephone no. of your company executive. It is neither printed on the box nor on the brochure.
From the foregoing it is clear that mobile’s malfunctioning is due to its manufacturing defects as the set has developed so many faults in seven months time during the Warranty period. What does the warranty mean if there is no body to listen to the customer if your agent at the micro service centre wants money for setting right the manufacturing defects even when there is no physical damage? In July my friend who had also purchased the same model found similar defects in his mobile which were set right free of charge by your Lajpat Nagar centre which is now under renovation hence I went to your Kalkaji centre.
Since I am left with no alternative but to pay money and get the mobile repaired. I am requesting you through this E-mail to either tell your Kalkaji centre not to charge me for repairs or you will have to refund the money with damages and cost. Please note that in case my complaint is not attended to by your company, I shall be constrained to take further steps including going to press /media as advised and deemed fit on your cost & consequences. Please note that I shall be going to your Kalkaji centre on 30.9.09 for repairs so that you have enough time to advice your said centre in the matter.
