Nokia 5610
Poor service

I have bought a nokia 5610 five months ago. the body of the phone is very fragile and brocken in one month. i have given the phone to customer care in bijnor (arora commu. ) 9th of march to change the body of the phone . but till now i did not find a answer from care. they told me that problem will be solved in 30 days. they take repairing charge in advance . but i did not have my cell phone till now (26-05-09). may i go to the court to get my phone back?
