Faulty Nokia 5800 Express Music

I purchased Nokia 5800 Express music on feb-13th 09, after a weeks time I am facing the earpiece problem I am not able to hear and have to continiously use speaker. When I approched the Mobile store from where I purchased the mobile, I am told to visit Nokia Customer care. I approched Nokia Customer care, Initailly they told some part need to be replaced but part is not available and they temporary fixed some thing. After two days again the same proble started, when I approched the Nokia Care two days back, I am told the part is available and come next day, when I reached Nokia Care yesterday I am told part is not available and come again. There was no responsible person at Nokia Care, Shop no 18, D P Road Aundh, Pune.

It is really furstating experience. If this is not going to resolve soon, I am planning to go to media and go to consumer court.
