Got a damanged piece but noted it only after 2 days

Hi

I brought this mobile from mobile store in chennai nelson manickam road on 7th august mobile panel is not intact and hence I can see the display light from the small gap, The problem is that because of this reason the incoming speaker is vibrating and i went to nokia customer care and they said they will take about 10 to 15 days! but will not gurantee about the replacement! Imagine guys brand new mobile 2 days old and giving it to the nokia care for 15 days! I would like to know what can i do to get the handset replacement or can I sue them legally.
