Attery problem

I have purchased Nokia 6233 model cell phone on Feb.2007. While charging the battery it becomes hot, recently I have opened the cover and found that the battery has swollen and after full charging battery discharges quickly. (After 6-7 calls)

There for I want to confirm from your side for how many period your warranty stands for battery.

Is it safe to use the same battery or to replace.
