Attery is not working properly and the back panel is loose

The battery backup of the phone is very low and the back panel of the phone is loose from the very first day.i have been to the shop to complain that defect but they are not listening.i had been to NOKIA Care also regarding that but they are telling that they are not able to rectify the problem.please help me out...
