I bought a Nokia Mobile phone, model N 73 from Hotspots Retail Limited, from their outlet at Shop No. 3, Local Shopping Complex, Mayur Vihar Phase – I, New Delhi – 110 091.

At the time of purchase, the seller offered the “HOTSPOT CAREPACK”, which is a two-year warranty against liquid and physical damage & one-year additional service warranty. So, I bought this by paying an additional amount of Rs 1200, as above.
The phone was working well till a few months ago, when I observed that the on-off button on my phone was not functioning well. So I had approached the Hotspots Retail Shop in end July and handed over the phone to them for repair. After several weeks of follow up, the phone was finally returned to me saying that the phone is not working and that the instrument can not be repaired. Instead of repairing a simple fault / malfunction, they have completely damaged the phone with the result it can not be used at all. It is clear that in the process of trying to repair a very minor malfunctioning, they have completely damaged the instrument but refuse to accept their carelessness.
When I demanded replacement of the phone, they have refused citing the fine print in clause 4 of the Carepack. As you can see, this is a clear case of cheating.
Kindly advise how I should redress my grievance.
