Did not get phone repaired in 3 months

I have submitted my Nokia 5300 with noika service center in Janak Puri (Global Communication) on 27 Sep 08.After repeated reminder and visit on 25 Oct 08 i came to know that my phone has been repaired and given to other customer as a stand by which he took with him to jaipur, and i will get it by 1 week when he will come back. On 18 Dec. they said you can take his phone as a stand by and use till we get your's and to my amaze when at home i tried to charge it i failed as the phone is not charging. Their manager suresh yadav never picks up any call.

PLease suggest what should i do.
