Problematic New Phone

I purchased this Nokia 5800 Express Music phone (IMEI-354182028557344) on 16-3-09. I registered first complaint with in a week for which Noida Care, Sec. 2, Noida deleted complete data saying it needed software updates.
Then I reported that the phone is not accepting my SIM. I was told it was because of card problem as the phone is a High End phone. I got my SIM replaced through Vodafone twice.
The problem persisted. When I went the third time (within 15 days of buying), now the Service Centre is saying a part is damaged because of insertion of card. So:
- Since this was not reported first time, something happened from Centre's end
- Error reported second time was same as the third one
- No warranty is provided by centre now and repair estimate is rediculusly high (6000/-).
Now, is there a way by which I can complaint same to Nokia without taking the legal path?
