Replacement of Hand set

I purchased h/s no. 353228015365174 in May 07 product code 0541498 model name 6085 warranty ref no. APAINY082111825. Instead of giving new hand set as replacement the dealer Divine Cell Phones has offered repaired hand set and told me that this is the policy of the NOKIA. Please let me know that is it correct policy of the company or the dealer is playing mischief? Please reply without further delay as I am without handset for last 2 months.
