Hardware problem

I bought a new mobile phone (nokia n79 IMEI-356044030328601), and after 2 days it has started with its hardware problem. so the shop where i bought it from suggested me to apply for the DOA against that faulty handset. and i was supposed to get it within 10-15 days, but after that still i have not get the new hand set. i am just fade up with the service of nokia company and now i have decided to file a case against that shop and nokia company.
