Manufacturing defect-Refusal to replace

I bought a brand new Nokia E51 (colour-grey steel) cell phone bearing IMEI No:358997016542552 on the 30 th of March from a authorised nokia dealer. Within a months time the phone just died out. On switching the phone its simply displayed a message saying phone start failed pls contact retailer and then sim card invalid. on showing the sim card invalid message i tried a nmber of other sim cards but all in vain. After this the only option i was left with was going to a nokia care store. But i knew before hand that going a nokia care center was like banging my head against the wall, all the personal experience i had with nokia over the past 6 mnths when i was forced to change 4 phones on account of defects and unaccepatable repair standards resulting in the loss of money and information.
At the Nokia Care Center in Chembur, Mumbai i was asked to leave behind the phone for 10-12 days as it was detected of some hardware problem and had to be sent to the HO. I tried to contact and communicate with people at Nokia but to no use. They were extremely rude and just completely denied the fact that there was a manufacturing defect. I wanted to seek a replacement as a phone not even a month old having a hardware problem should be replaced and not repaired. Why should i as a customer after having paid the complete price take a repaired phone instead of a new one. I visited the Nokia Care Center in Chembur after 12 days and was returned my phone. 5 minutes after having left the care center i inserted a sim card and to my surpeise i get the same message earlier. PHONE STARTUP FAILED PLEASE CONTACT RETAILER AND INVALID SIM CARD. i took the phone back to the center and was asked by the technicians to leave it behind for another 10 -12 days as again it would be sent to Delhi. It cost me a lot of time, money and information as the loss of conatcts etc. Nokia yet again failed to communicate. Customer Care representatives were very rude and arrogant and did not pay heed to any of that i said.in fact they said that even if i wud get a replacement my phone would be replaced by a second hand phone and nota sealed one. Well now NOKIA IS DISCONNECTING PEOPLE. I have been asked to collect the phone tomo and and it has been repaired and not replaced. i do not wish to accept a repaired and defective phone for no fault of mine and i demand to have my defective phone replaced. Whatever it takes if that even means to take legal action against this so called reputed company. I as a consumer request you t help me get the phone replaced.
I would also be sending a carbon copy of the above complaint to the TOI and HT so that my voice can be heard loud and clear by those deaf ears.
