Sub-Replacement of new brand handset E63 due to manufacturing defects.

On 27-3 I, Suryakant R.Adate purchased a brand New Nokia E63 R. Red, IMEI 359319021876249 – for an amount Rs 12, 375 for giving a gift to my son Vishal on account of his birthday, from M/s. MOMENTO, 16 A Kalpita Enclave, Sahar Road, Andheri (E), Mumbai:400069 (Tel: 26822084/56789890) vide Invoice NO.2319 dated 27-3, who had procured the said handset from M/s. Fine Collection at Irla.

On the same day in the evening the phone starting giving a very breaking and cracking sound when it was dialed from handset to the landline or to any mobile number. On 28-3 in the morning hours at 10.15 AM I showed the handset immediately to the Nokia Care i.e FONEMAM, 8 Gopal Bhavan, Near Pallavi Hotel, Azad Road, Andheri (East), Mumbai. The technician told that there is fault with the speakers and the same after it was got repaired collected on 3-4. Thereafter the problem developed with the display of top rows sentence as only half letters were visible viz. “Home Screen Applications” it shows only “Home Screen”. The hand set was again taken to the above Nokia care centre on 4-4-09 who could not solve the problem after making all attempts and told that they have to sent the set to their head office at Lower Patel for repairs or replacement. The handset was accepted for repairs at FONEMAN Nokia care centre vide Job Sheet Number 064434038 / 090404/ 29 on 4-4-09. There appears to be a manufacturing defects in the said handset.

I was very entitled as per your rules for replacement of above handset. The same was refused by the above shopkeeper since the hand set was opened in the Nokia gallery for inspection. I as a comsumer was not told by the seller about the conditions at the time of the purchase. If I was told that any problem with the handset within 48 hours should be brought back to the seller and not to submit in the Nokia care gallery, you think I would made this mistake? This is an utter lapse on the part of MOMENTO from whom I have purchased the said handset. I as a consumer will definitely not bear the brunt for the inadequate information to the consumer at the time of purchase and the inability to present the replacement policy to the consumer, when I have spend good 12, 375/= on brand new hand set.

Now, I and my family have been Nokia users for many years. Such kind of an incident has really put me off the brand and lost trust in NOKIA. The past 8 days have cost me of my time, energy and mental harassment after spending about Rs.12375/= on brand new hand set. I am willing to take up the matter to the highest levels of Nokia if the matter is not resolved within the next 2 working days and the request for the replacement of the phone is not adhered to.
