Pathetic after sales service

I had buy nokia 6300 before 3 month.

function of mobile is good but there is one problem getting started when i put my mobile for charging there is heating problem & within one houre half bateri geting low inspite of full charging.

because of these problem i go to monile shop where i purchase my mobile they keep mobile with them for sending it to service centre.

after 15 days they give my mobile back but problem with phone remain same.

can i get replacement of my mobile & if not what can i do?
