Very bad battery backup need a replacment

This is a new handset that i have picked up on the 24th sep 2008 from the day 1 itself there is a battery back up problem had been to the service center got the software checked but still have the same problem when asked for replacment they said they ar not going to give a new had said but will give something similar which is not right as this is a problem from the 1st day and also that it will take min 15 days & that it cant be replaced immediately where as what do we do as all my work depends on my mobile please do the needful as i never go for any other product and have not faced this problem before
