Company policy of replacement

The replacement policy of nokia says to replace a handset witha working condition phone only. so whats the policy if the phone is replaced within 10 days of use..?? they are providing me witha set wich is 6 month old as a replacement. i've used my new set only for 10 days after which it got some problem. contacted nokia care & they are not able to repair it. and after 1 month they are replacing me with a phone fully scratched & tampered. please help.
