Faulty Nokia phone from Planet M

I bought a Nokia Mobile 5130 xpress music from Planet M KOlkata, city centre, salt lake centre on 13.07.09 evening. I did not test the accessories at hte store and back at home I found a lot of problems in the phone. The head set was not working at all and also the sound quality of the brand new phone was far inferior to the quality of the xpress music series. I guess they have given me a used phone or some test/display pack in a new wrap.

Guys, can anybody suggest and advice a redressal for the same.
