Evisal of flat rate after decided written agreement

Dear Sir,

I booked flat under construction in Feb at plinth level. Since i am in merchant navy and NRI, i had to leave immediately after we had a written notarial agreement in which 55 lacs with 2100/sq feet rate ws decided for flat in Nasik. I already paid him about 22 lacs in stagger way within first 6 months when my slab was not even put. That time rates were down due to recession but in november when i came back and asked to get flat registered builder is asking me for more 7 lacs since market became better and rates have come up. Only fault he is telling me is that i didnt approved the loan in time but it was none of his business since already he got more money and since i was abroad on ship and bank wanting me in person for loan same happened. Please advice.
