Deposit Amount Refund of the reneted flat
Landlord refuses to return the security deposit amount on leaving the flat

I am Kamlesh Dayalani, On 15th June I with three of my friends rented a flat at Vashi (14, Shriji Kripa Building, Radhakrishna Mandir Compound, Juhugaon, Sector-11, Vashi). The owner of the flat / landlord is Mr. Ashok Mishra who resides in Ghansoli and has an office in APMC Market Vashi.

At time of taking flat on rent we have paid security desposit of Rs. 40000.00 and agreed to pay Rs. 10000.00 rent per month for the agreed flat. The flat had furniture and fixtures like bed, sofa, cupboards and a TV Unit (without TV). all these fixtures were well maintained.

The agreement was from 15th June to 15th May and we did vacant the flat on 10th May. The landlored than disagreed to pay our deposit amount fully and just paid Rs. 13791.00 out of Rs. 40000.00

Out of Rs. 40000.00 he had actually to cut Rs. 10000.00 of rent of May and Rs. 1209 of electricity bill pending and to return the amount of Rs. 28791.00 but he just gave Rs. 13791.00

The rest of amount deducted as mentioned by him is Rs. 10000.00 for an additional rent because we stayed till 10th May where in fact the period of eleven months was to expire on 15th May. Rs. 5000 deducted to clean the tiles where as when we came in the flat the landlord spent Rs. 500 for getting the tiles cleaned by acid liquid. The cleaning is required because the tiles is too old and have holes where the dirt get gathered and tile get dirty.

The landlord later had very bad behavior with us and when we said we'll got for consumer court complaint, he said he do not care of these courts and tribunals, all civil representatives are in his pocket and even the policemen are in his pocket.
