Unauthorised Sale of Unapproved Flats

I had booked a ground floor flat in Omaxe Grandwoods Sec 93B Noida in Nov and paid an initial booking amount of Rs 6 lacs. When i went to SBI as well as HDFC for bank loan, I came to know that the floor plans were not approved by NOIDA (authority). Thus neither bank were willing to approve the loan. Omaxe had not informed us that the ground floor plans were not approved.

Now I have requested them to cancel my allottment and refund my money. But the company has given in writing that it will not cancel the allottment and will charge us interest rate for delay in payment.

Even SBI has given me a letter that all my loan papers are in place and they would be willing to sanction loan on receipt of approved ground floor plans. As far i i see it the ground floor approval plans will not come any soon.

Can i approach the consumer court for such unreasonable demands by Omaxe.
