Manufacturing defect

I have purchased one pair shoe, article no- GC 0554108 form Aero Club, F-50, City centre, Salt lake, Kolkata on dtd-10/10/10. After 15 days I observed one cut in left shoe upper side i.e in elastc material. I have deposited the shoe in that show room on dtd- 06/11/10. They have given 5 days time for repairing or replace the shoe as decide by company. After many follow up they have called me after one month. I saw the shoe & not satisfied with the repair. They have only stich the elastic material. Is the stitch in elastic material success? As the shoe is only one month old I am sured this is a manufacturing defect because that position is a safe position & no any other scratches over there. So I requested to replace the shoe other wise I have bound to go consumer court.
