Refund of advance commission

We hired a domestic help from J.M.D. Personnel Search (Regd.) C-128/11, Kelakari Colony, Jeevan Nagar, Ashram, New Delhi.(011-26347677, 011-26347678)

In 3 months and 15 days time, the domestic help was caught stealing and hiding money from the house. She immediately admitted the crime and pleaded guilty. We called up the concerned agency people (at the mentioned landline fone) and they asked us to send away the maid with her pending salary.

We gave the salary for 15 days which was due and sent the maid away. The agency people assured us that they would be providing a replacement in a week's time.

The contract says that in case we want a replacement they will be providing us in a weeks time. After that we followed up with the agency and the same representative who had done the agreement and they kept asking for few more days time.

It has been 3 weeks and 3 days and they have still not provided us with a replacement. The contract also states that they would be refunding the remaining commission.

They took Rs. 10, 000 as commission in advance.

We have been trying to reach the agency people but they are not answering the phone.

Amount of Rs 7000 is due from them. The agency representative who had done the agreement is also not reachable by fone.

We have the original contract signed between us and the agency representative. Also we have the receipt of Rs 10, 000 which was given to them at the time of contract.
