Frequent unsolicited calls

I frequently get unsolicited calls/sms of advt. nature mostly bank loans. I do not know, how on earth they get access to the database of service providers. The cell nos are supposedly to be of secret in nature and there is a Supreme court of India judgment that the persons making unsolicited calls can be booked under law. Whenever I raise this point with such callers, they quietly close the calls. Barring the Police investigating team, no one should have access the data base and the service providers should ensure secured Firewall. Nest time when I get such a call, I would like to sue the bank or the advt. agency by quoting the time, date and the caller's no. I am not sure whether I could succeed.
