Nokia / N70 music edition
3G network not supported by N70

I have purchased Nokia N 70 Music edition 1 year ago after confirming that it is a 3G phone, but now MTNL started the 3G services in Delhi and it is not supported by Nokia N70. After confirming the Coustemore care of MTNL's they told me that I have to set the network in UMTS mode or dual mode for UMTS or GSM in phones's setting option, but Nokia n 70 has only two option GSM and Dual Mode, and after selection dual mode it not supports the 3G network, while My other nokia 3120C supports the same 3G SIM and networks.

I just want to know that is there any other setting for 3G or not, other wise am going to consumer court for compensiation for this false commitment of Nokia.
