Mileage problem

Purchased Bajaj platina 100 CC in may

.. I was assured an average of atleast 85 kms. was told you will get the average after 4th servicing. I am still getting the mileage at 48-53 Kms. I would like to know What I need to do legally (In case the problem is with bike). What I need to check or take care of to get the average? already check the bike to service station 3 times
