Non refund of TDR for waitlisted & RAC untravelled tickets

I have filed TDR refund request for PNR Nos. 8525345200 & 6436407315 but despite after repeated follow ups, haven't got any refund. While the 1st request was filed on 28th Dec'09, the 2nd PNR's TDR Request was filed on 2nd March'10. How come Indian Railways reserve the right to hold back citizen's money?
