More than MRP

Recently we advertised a tender for purchase of 200 mobile phones with following conditions :

1. Warranty 3 years comprehensive onsite

2. payment - 90% after receipt and verification of stores

3. Balance payment - remaining 10% against submission of Performace Bank Guarantee valid for the entire period of warranty.

4. onsite delivery and installation.

on receipt of goods and bills, we have found that, depending upon the model, rates charged is 15% to 60% higher than MRP. when we asked for clarification from the supplier, he has replied that since they have supplied with additional components like extended warranty, different payment, onsite service etc. the MRP factor does not apply. He also writes that MRP applies to standard product and services, which includes standard warranty, cash & carry, rate at selling counter etc.

on enquiry from manufacturer, we are informed that they donot have any additional warranty rate. after lapse of standard warranty, the equipment will be repaired on cost at their service centers, which can vary from model wise and fault wise. in such case, if the supplier undertakes to render additional warranty services at an extra cost, it is suppliers responsibilty and the manufacturer does not have any role to play.

we would like to understand as whether we should stick to MRP and release payment as per MRP.

what is the standard interpretation of MRP under Indian Law.
