Not returned balance amount/ product

I bought Nokia N97 from MOBILE STORE on 3/06 and when i open the box camera was not working fine and it got replaced with Nokia E72 as he was not having stock of N97.There was a difference of almost 2011.00 and he told me we cannot return the cash instead you can purchase any item for same value. I couldn’t buy same day instead i went on 1st of AUG he said the amount is no more valid as it has crossed one month. Please guide me to go head.

Please note that it was fault with Mobile you have given, still i agreed i will buy for the same value as he cannot refund. Now i required the cash back and don’t want to deal anymore with mobile store.

The contact person is Mr Shiva. He doesn’t have any courtesy and don’t know how to behave to customer.
