Giving back damaged phone

I had given my nokia n 97mini for repair to satya telecare, 229 chitaranjan avenue, kolkata-6 for software updating &redial function was not working.on delivery i saw a crack on the tail end of the phone.on enquiry i was told that the crack was there before itself which is a lie because they would have mentioned it in the job sheet no:271504886/101214/38 & IMEI no:351979040260473. please return my original phone at the earliest.i have given several complaints to the company but they are not responding.
