Customer care of nokia speaks so rudly

Dear sir i brought nokia lumia710 from local vendor its not been even 1 month, I occurred a problem of calling. Actually when use headphone for calling any no. Or via any headphone the voice come very bad and it don't get decrease and increase. It will be on full volume.when i went to nokia care they spoke very bad and abused me said need to put some software and they were about to open each part.

I didn't allow for that. Can't i clam for a new set
