Defective handsets

I m Rahul recently bought Motorola defy plus from Akash electronics in Sec-18, noida. On the very first day it screen starts flickering so i went to shopkeeper and told them about it but he refused to take it back and sent me to service center where they told me it takes 3 days but it has been 10 dsays and there is no gud response from them.
