I received a call from the India Today Book Club on 13th Nov (approx), giving me an offer to buy an HTC Touch 2, claiming that it was a 3G phone. I paid Rs.16999/- through my credit card over phone.

On confirming with HTC, I got a reply that it was not a 3G phone.. I immediately shot a mail to ITBC that they need not send the phone if it was not a 3G enable one. I also told the sales rep. (a guy by the name of Akshay Sharma who incidentally called the next day to sell some thing else!) about the info from HTC and asked him not to send the phone. He claimed that he has talked to his seniors and that it is a 3G enabled phone indeed.

Now comes the interesting part. When the phone arrived after some time, I found that it was not an HTC Touch2 at all! It was an HTC 3470! An obsolete model.

After that the nightmare has started. I have been sending them mails after mails and have called them umpteen times. I have sent the POD and the delivery report from the courier and they say they have not recieved it (the mails were sent at the same id on which the orders and feedback are sent). Then, when I have sent the scanned copy of the POD on all the 4 ID's that they mentioned, they acknowledged the mail as well as over phone that it has been received and the refund will be processed maximum in 21 days.

After 2 weeks when I call again, they say the POD has not been received and they are escalating the complaint!

I have never seen a bunch of liars like this company in my whole life! They are simply sitting there to cheat people as is evident from the number of complaints against them.

I was wondering if you guys can help me in filing a complaint in the Consumer Court. I have ample documentary proof against them and the case can easily be proved in a court of law. More importantly, I just want to warn people against falling in their trap. They lure their preys by giving tempting small offers, fulfilling them and then doing this on a big order.
