Non Delivery of product niether refund in time

I had ordered a pair of shoes online at www.bigshoebazaar.com

on 1st Apri 09 (Order number 1105251) which was supposed to be delivered

in 4-7 business days as per the order confirmation email. On 15th April 09

I asked about the status of my order as it was more than 10 business days

and the product was not deievered to me yet. I followed them up

consequently on 17th April 09 on which I had no reply. When I called them

up they told that the product is out of stock so i asked them to refund

the money back. On 24th April 09 i sent out a mail again copying all the

contacts posted on the site stating the credit card payment due date and

requested them to refund the money before the due date. They agreed on

this email and confirmed me that they will refund the money immediately.

But the same did not happen after and my credit card payment was overdue.

I sent a reminder on 29th April09 but still no reply from their end. On

5th May09 i got the mail to send out the order number which they already

had sent me in the order confirmation mail on 1st April09 then they told

me the product they had ordered is out of stock which they had already

told me on 17th April09. Then I got another mail that they woud refund the

money within 10 days. I sent out a mail that they should bear the cost of

late payment and interest applicable on the purchase made since they had

not refunded back the money in time despite of informing them. Since I did

not get any reply I called them up today and they told me that they will

not bear the interest charges and late fee on my purchases.

Consequences: I did not get the product and since the money is not

refunded back I will be charged the interest and late fee.
