Fee refund on withdrawal of admission

After attending classes for 12 days only from 18.08. my daughter had to withdraw her admission on 03.09.2008 from DBITW Dehradun. The institute filled the vacant seat later on through counseling of Uttarakhand Technical University on 20.10.2008. As per the rules of Ministry of Human Resource Development, if the vacant seat is filled by the institute, it has to refund the fee after proportionate amount of deductions from the fee. The institute has refunded only Rs.48, 200/- so far out of the total Rs.76, 400/- deposited with the institute. The proportionate deductions comes out to be around Rs.6, 000/- only whereas the institute has still withheld around Rs.28, 000/-.

Please guide me if I can institute a case in the consumer courts or any other courts.
