Exchange refused for damaged headphone

Dear Sir/Madam,

Since i would be travelling early morning sunday ie.29/11, I had gone to Oasis Mall late friday (27/11) for some emergency shopping. I eventually purchased (1) A laptop trolley for Rs.2399/- (2) Shoulder carry Leather Bag - Rs.999 and (3) I-ball head set from SPAR hyper Market.

Since the I-ball headset were in a packed condition, there was obviously no choice of testing or seeing if it is in a new condition, but considering it sealed and a reputed brand i purchase the same presuming it will be in a new condition. On reaching home and opening the seal, i discover that the holder of the head phone (the plastic set that hold the ear piece) was partialy damaged and the holder was extremely loose (does not have a good grip over the ear).

The very next morning i went to exchange the same but reached Oasis mall at 10 am prior to opening time and so went back there in the evening around 6:40 pm. At Spar exchange counter, Mr. Sendil the incharge point blank accused me that i must have scratch the head phone against a wall and hence he cannot accept exchange. I tried convincing him that i just bought the piece the other night and have never used it but he refuses to relent and continue to accuse me of trying to exchage a piece I had damaged. My obvious and surprise reaction "are you mad why would i wear that and bang myself against the wall? I have not used it at all"... to this another attender took serious offence (God knows for what reason) and was showing signs of aggresion untill he had to be shooed away. Now, I believe this is all a well orchestrated plot to refuse exchanges at Spar hypermarket.

Then I spoke to Rajan, the store Manager but he turned out to be no different. He came up with new line of denfence that electronic items cannot be exchanged and testing is allowed before purchased. This came as a surpise because they generally do not allow you to open a sealed item and test it! I pointed out to him that such condition is not included in the terms of the exchange. But her refused to hear anything and stuck to his point.

I understand that damaged goods cannot be exchange ie. if damaged is caused by customer, but if the Company sells damaged good in a seal pack, what is a customer suppose to do? Isn't he/she entitled for a brand new piece he deserve and paid for? This attitude of SPAR employees and the policy is totally against CUSTOMERS like me. I understand i can still use the product, but hey i purchased a new head set and it looks like a 2 year old with a damaged part, am I not entitled to have a product brand new, when i have paid for it? Is that asking too much?

Would be really grateful if the same can be taken up with SPAR and they are asked to provide replacement of the damaged product any any such suitable action as may be deem necessary by your goodself. I am hurt for the way i have been treated and willing to co-operate in whatever manner necessary.
