KIRAN TOWER MALAD WEST
Delay in Possession over 2 years

This is with reference to a 2 BHK flat taken by me from Mr Kiran Asher, builder of Kiran Tower, off link Road, Malad.

At the time of purchasing the flat, we were promised that this building will be jewel in this area once it is completed in December however till today the building is far from complete.

Whenever i call the builder, he keeps promisisng that it will take another 3 months however, none of his promises have come true. I even filed a complaing with the police but the inspector said that we better file a case in consumer court. Going by the average time such cases take and legal expenses involved, a common man like me, who had put in all his life savings into this flat, doesnt know what way to go.

In Aug when i took this flat, i was told that the flat will be ready by Dec. I took a home loan from Indian bank (though my loans from HDFC and ICICI was rejected as they didnt pass this project) where i started paying EMI from the salary that i was getting from a good job that i had. I kept paying EMI and also from time to time i paid on every demand made by the builder on specific completions. When i lost my job in i never expected that i will be stranded like this where i didnt even have the flat for which i had paid and also, i had to take a flat on rent (as i got married in Dec) which gave me additional burden.

Now the stress is unbearable as my old aged parents are facing health issues due to the tension given by this builder.

I want to know is their some law whereby such builders are severely punished and cant escape by bribing government officials. WHy does a common middle class person like me have to suffer??? In this 21st century, we still continue to go through this mental agony and such builders continue to play with the system and make huge money by fooling us.
