Yeah FAP makes no sense, think about it. If everyone is downloading excess, THEN FAP kicks in, how did the satellite handle it in the first place? Wouldn't it be better to let the system strain under true bandwidth crunch by its users than force a virtual one? At least if you let the people slow it ...
