A verna (Hyundai company) car purchased by me, financed by magma shrachi financed ltd through dealer m/s sant hyundai distt kangra on 29th may.
I financed a sum of rupees six lacs, Out of this magma finance send fax msg. to sant hyundai, in which they mention that our liability is limited Rs.585370/- and you are requested to collect balance amount from the party before delivery of the vehicle.your payment will be made within seven days from the date of delivery.(Before this episode magma company collect 59 cheques for Rs 12360/- each and one installment in advance cash, to collect by dealer at the time of delivery). After taking delivery proper document of the car not received so far. I contact with finance company and dealer, they told that you will get paper soon and also assure us before deliver of proper paper we will not produced any cheque for the collection. Three months gone paper not received so far and nor proper response so far from both side and finance company encash three cheques at one time on 11-9-08. I again contact to dealer/Finance company for the same matter and ask them what happens, then he told that finance company made payment Rs.41929/- short (Received D.D for Rs.543441/-) that's why we can not hand over vehicle paper to you. Then I lodge a complaint in consumer court on both parties. Upto today no decision made, matter still in court and fresh date for order is 12-5-11.I have cleared all cheques of Rs.12360/-(Except 4-5 cheques) approx. Rs. 5 lacs paid by me (car cost is Rs.7.55 lacs) but no favorable response from any side so far. Now I suffered so much and now position is at present not able to clear further cheques. I have heavy losed in business and mentally upset due to this matter. A small car valued Rs.4 lacs also again financed by another company and also invest Rs.1.5 lacs on starting margin money plus monthly installment. And verna car kept aside from long period because due to proper paper it can't drive on road. Kindly help me in this matter. All the copies of concerned papers with me i.e D.O letter, D.D copy and other necessary document.
