sir, please send me copy of the file of our matter in your office, I need it in case in the court & Mr. Lalit kumar (MOF) also told me that take copy of the file/letters with IRDA. I also request to Mr. Ranbir Singh (JD, Regulatery) & Mrs Yegnapriya Bharath (JD.COMPLIANCE) but they told that file is with chairman's office, so I am requesting you.

Letters of MD, SBI, Mumbai & GM SBBJ& cutting of DAINIK BHASKAR also attach.

I again request you & want to know that what action you are taking against the surveyors (Mr. Bakliwal, Mr. Dameja & Mr. Mir). When public not fulfill their demands or not in position to fulfill demands then they never take their genuine claims due to them.

Sir,

I am running after these depts.(National Insurance co. Ltd. & State Bank Of Bikaner & Jaipur) from last 2 years but they are not settling the case, I also take up this case withIRDA, Hyderabad, DPG, New Delhi, Ministry of Finance, Banking & financial services, New Delhi, competition commission of India, New Delhi, Insurance ombudsman, New Dehli.

No reply have been given by National insurance, in the mean time insurance company appointed 4 surveyor but not settled till today, Very first National appointed surveyor after 6 months.

Now I am forwarding this matter with you.

Please instruct to appropriate authority to settle this claim case.

This company was not providing terms & conditions to the insurers from last 10 years & when claim arise they apply terms & condition. When I demand under RTI to this company they send me Zerox copy printed in 1998.

The National officials & Surveyors manipulating the case from long-long period.

My banker taken insurance from this company on behalf of me from last 18 years & debit my account to complete their official formality/Audit objection & after that they have no interest in the customer's loss, this claim arise Ist time & I am paying about Rs.30000/ per year.

Sir,

I receive a call from Mr. Mir, Surveyor (9829115864) on 20th feb.2010 about 5 p.m. and he was telling that I was appointed in your matter by H.O. Kolkotta & I want to meet you, I am at Rama Motors, Gopalpura Road. At that time I was also 1 km away from that place, so I tell him That I am coming there. When I meet him He have a Zerox of whole claim file & When I tell him that I have no information about you then he told that I was appointed directly from Kolkotta H.O. & this file also with me.

Then I call to Mr. Nadhamuni (DGM) & tell the whole as above but he told that I don't know about that I am calling back to you After 10 minutes he told That Mr. Rai (RM) is not available this time, the latest in the matter will see on tomorrow. On Tuesday evening I again call to him but phone was not responding. I send a sms on Wednesday to him then he call me and said that I am in Chennai this week & you will receive a call from R.O.

I also call on that day to Mr. Kuldeep singh (9748493000) GM (TECH.) & Mr. M.C. Agrawal (9903639097) chief manager but he told me that I am calling back. I also call to Mr. Prasad's office then his staff told that you will receive call from Mr. Singh.

I also call that day to Mr. Rai (9549139563) but not responding.

What game was playing by surveyor & National I don't understand. Every person was saying that we have not appointed any other person but how the claim file with Mr. Mir.(surveyor) of residing at Murlipura scheme.

In 6 month III rd surveyor have not submit report & after that Mr. Mir is also here.

Please do needful in the matter because About 2 years have been passed & what manipulation was doing by the co.and surveyors.

The details of this claim matter already with you.

He came in very busy schedule. I told him that I personally visit the demaged stock & premises at that time & then try to cordinate with the National Insurance.

Mr. Jain told that he already given the papers which co. is demanding again and previous surveyor also meet with the staff in Nov.08.

Further I want to disscuss with him other issues but he told that My wife is sitting in the car for going to pension office & I also go 100km. away from here at 3 p.m., I & Mr. Jain also request him to visit shop which is about 200 meters from here but he told that come next time.

He left my office at 1.15 p.m. & tell me I will talk you later.

This matter is against National Insurance co. ltd., which was

also given to Sh. Sriniwasan (Non life Insurance) and also issue letter

by him to the co.

This is for your kind notice that the surveyor write in his report

in para III that entrance gate of the basement is at a distance of 5 ft.

from boundary wall gate, when the entrance gate is at a distance of 15

ft. from our boundary wall as you may see in the photograph also in the

file (Permanent construction) & you send any person to visit it.

The surveyor is submitting his report on 15/11, when he come

for survey at my godown on 16/11 & issue letter on 5/12 as

reminder - 1 for submitting various documents by speed post (copy of the

letter is with me). as per survey report, it is stated that "The insured

not provided any geological dept. report", Which report is issue by

geological dept, i don't know (on page no. 2nd, para no. VI) when we

provide papers till 10th th Dec. then how he prepare his report on

15/11. I can send a copy of that survey report.

He was also stating that by wind pressure the showers also entered

from the entrance gate of basement. Our basement entrance gate is 15 ft

far from Boundry wall and after that (4ft. of rcc balcony and 7ft.

covered by fibre sheet (clear in photograph), then how (as per

surveyor) showers enter in gate of basement.

I am also not understanding that when surveyor dispatch his report

at the last (Page-7) of the report is on 15/11

I and your branch make repeated requests him to visit our shop at

1459, sanghi ji ka rasta, Jaipur on which the another policy was taken

by bank but he never visit the shop & he treat all the stock on our

godown and apply average clause.

I also provide him news paper cutting of Danik Bhaskar & Rajasthan

Patrika for the day.

Our banker also write 5-6 letters to your RO, DO & crossing selling

dept. but not receive copy of prorosal form and in the last they write

they have no record by their letter dt.9/6 by DO - I, Jaipur

I AM UNDERSTANDING THAT I AM SAFE BANK HAVE TAKEN INSURANCE POLICY FOR ANY KIND OF LOSS IN OUR BUSINESS PREMISES BUT WHEN I GO FOR INTIMATION TO BANK & INSURANCE, THERE IS NO POLICY WITH THE BANK AND WHEN I CONTACT TO THE NATIONAL INSURANCE CO. AFTER RECEIVING LETTER FROM INSURANCE CO. I ASK MY BRANCH FOR INSURANCE POLICY BUT THEY DON’T HAVE. THEY CALL SO MANY TIME TO THE CO. BUT THEY HAVE NOT SEND POLICIES.FROM LAST 8 YEARS BANK NEVER ASK US FOR PROPOSAL FORM AND NOT GIVE ANY INSURANCE POLICIES TO US.

THEN I CONTACT WITH NATIONAL INSURANCE CO. LTD. H.O. CHAIRMAN CELL .I TALK WITH MR. M.C.AGRAWAL CHIEF MANAGER &CPIP.CRM DEPT. KOLKOTTA ON 23/9 AND HE TAKE UP THE MATTER AND GIVE REPLY THROUGH MAIL AND ALSO CALL TO MR. SUBODH KUMARSWAMMY SRM, JAIPUR, MRS. SHALLY PATNAIK . BUT NOTHING HAPPEN IN THIS PERIOD THEN AFTER ON 4/11 THEY HAVE OFFICIALLY LODGED COMPLAINT NO. HO: CRMD: JRO:09 11/243:G DT. 4/11 (AFTER PASSING 5 MONTHS). THEN ON 5/11 INSURANCE CO. IS APPOINT SURVEYOR AND HE VISITED OUR PREMISES AND TAKEN PICTURES ETC AFTER 5 MONTHS, AND HE DEMANDED PAPERS I.E.B/S OF 2 YEARS AUDITED PROVISIONAL TRADING A/C BANK LOAN SANCTION LETTER STOCK STATEMENT OF LAST 12 MONTHS PAN & TAX AUDIT REPORT.

I HAVE PROVIDED HIM 07&08 AUDITED BALANCE SHEET WITH ALL ANNEXTURES, TAX AUDIT REPORTS, BANK SANCTION LETTER, STOCK STATEMENT - BANK'S COPY, SALES TAX REGISTRASION CERTIFICATE, SHOP ACT CERTIFICATE, BANK STATEMENT FOR THE YEARAND PAPER CUTTING OF DAINIK BHASKAR OF 17/6, RENT RECEIPT.

Sir,

You have seen what procudure they have followed without proposal, cover-note/Policy & when claim arise then their branch manager write for policy which co. sent them after 6 months & Bank saying that they have taken comprihensive policy, what is the meaning of comprihensive & they also write in their sention letter (Insurance of stocks against all prescribed risks - COMPRIHENSIVE). What instrastions/steps taken by you in this 2 year period & IRDA also issue show cause notice to Chairman, SBBJ in this matter.

Please take up this matter on urgent basis.

I call to Mr. Gopalan & Mr. J P Singh in the matter but they told that calling back but call back till date

I also send RTI application to your corporate office before 2 months but I also not received any reply/copy of whole file including reply of SBBJ.

I send you letters of National & Bank both in National letter of 23/6 (also with you) they have reputed claim & also not conduct survey, in which clearly mention that Shopkeepers Policy taken by bank & loss in your godown, not payable under this policy T&C.

Bank also write in their letter dt.25/9 that taken shopkeepers comprihencive policy (it means cover all risks) but Insurance co. said not cover but why, If Bank saying, policy duly taken by Bank to safegaurd Banks & our interest but where interest saved.

You are agree with this type of Bank's onesided reply.

I send you the whole correspondence of IRDA, MOF, New Delhi, DPG, New Delhi, Bank.

When National appoint surveyoer after 6 months after inferance of MOF, IRDA.& then after 19 months, they are saying not cover under the policy T&C.

This letter with ref. to your letter No. SBD/VMN/2500 Dt. 11/10, as you told that meet to CGM, SBBJ, Jaipur, I meet her on 14th Oct. But they have no answer in this matter, I brief her the matter then they told all the faults was insurance company level when bank is a agent of that co. & taking commission on the whole collected premium. The insurance company was saying in reply to DPG, New Delhi (letter dt.18/8 Ref DPG/I/00085) that Bank incidentally corporate agent of the co. at the time, on behalf of insured complainant, As per practice, all the operating offices are supposed to send a computer generated sheet/schedule together with relevant policy terms & conditions immediately after acceptance of insurance to the bank/insured and in this case 2 policy send to the banker, but policy was not send to the bank by the co.at that time if yes where was the policies, why bank don't ask to the co., what is the fact & terms & conditions was so far because all the policies laying with bank are without T&C till date also Bank only debit the account of the customer & send money to insurance co. & take their commission and after that what happen they don't any concern.

This is the system of the bank to safeguard Bank's & their customers interest.

I am also attach IRDA Regulations

I also meet in this matter to Banking Ombudsman Mr. P. Vijay Kumar first they told that go to IRDA in this matter as we write letter to you earlier but when I brief them then he told that how it is possible and they have decided to reopen this type of sensitive case & also told why bank submitting wrong facts to their office.

I also received a letter from GM (O) No. CGRD/2709 Dt.25/8 in that letter they are saying:

1. The insurance policy taken by Bank to safeguard as well as the bank & us, but both interest have not saved by this policy.

2. They write that Comprehensive Shopkeepers Policy was taken by the bank when bank had taken shopkeepers fire policy on my godown you just see the letter of Insurance co. of 23/6 (Page 1 in attachment-1) they have first repudiate the claim due to this only & only the reason that they have not appoint surveyor for this. What is the meaning of the comprehensive Policy, you better know (all risks cover). When in March internal, concurrent & statutory, auditor make audit what they have seen when policies are not available then they mention in audit report or not.

3. When the comprehensive policy how they Deny for any kind of loss, when they take more premium on shopkeepers policy than godown policy (Higher Rate) & which DPG letter reference they are giving the DPG call National to his Delhi Office on 27/8& when she don’t satisfied from them then they forward the whole file to Ministry of Legal Affairs for expert comments.

4. The insurance co. send letter of 17/3 to bank, IRDA & Ministry of Finance ut they have not send letter to us when I meet to their DGM then they send letter to me on 18/5 (Duplicate)

(i) How bank saying that they have taken correct policy if they take correct policy no question arise in the matter.

(ii) They are saying delay in receiving policy was not a material reason If in time policy serviced by insurance co. & bank, we all in position to take action accordingly, this was also came in to notice that as per our corporate agreement the insurance co. also send a copy of policy to the customer but there is no practice in bank as well insurance co to service policy to the customer.

(iii) Bank never try to appoint survey in this matter Ist The IRDA instruct them to appoint surveyor & then DPG, New Delhi & Ministry of Finance (Banking & financial services), New Delhi force them.

As they are appreciating their investigating officer Mr. Nagar, the details send by us to in the mail of 8/9 (detail mail attach). In this period of about 28 months bank’s branch manager, chief manger, SMECC officers & auditors inspect & then write letters to insurance company in this matter & after 28 months bank open their eyes and decide for discreet enquiry after interfere by you what they are doing from this long- long period, what they want to prove, letters written by bank & visit of their officers are no mean or they are not competent. This is also in the notice of bank that our contractor of labour along with all labour had left in Feb.2009 after visiting of Ist surveyor & Ist surveyor meet & enquiry in the matter,

This is the position appraised by CGM, SBBJ (Mrs. Menon).

Now you will attachment 1 where all scan soft copies available, then see & take necessary steps in the matter.

I receive a call from our Ex. Manager that he want to meet so I told him, come any time then he told that we are coming about 3 P.M.

He come to my Factory on 1/09 with auditor Mr. Nagar at that time I was not there. Mr. Nagar directly go to my factory in my absence & make some queries from my labour When I come they are about to go & meet to me at the gate. I told them come inside & take something & when they came inside Mr. Goyal told me that he is Mr. Nagar & auditor of the bank but they have not disclosed why they have come. I told him that If you come as a auditor then note down some facts in your noting about my insurance matter which was pending with the bank so many points discussed with him of the matter but he don't tell me that he have come for the same matter.

When some person was coming for examine/investigate some matter, he will give information or not.

I call to Mr. Mehta (M.D.Sec) & Ms. Chhavi Jain & give it in their notice then Ms. Jain told me send it in writing.

SBBJ Bank send their officer on 1/9 with their auditor & they come in absence of me & go directly to my works only 3-4 worker are working their & that time my staff was also not avelable, when I come they are about to go (meet on Gate) then I told how you have come & going, come some thing but both of the officers not told me that why they come I am understanding that they have come for the regular audit formalities but then they come inside I told them that also drop in your report about my insurance matter but they don't tell me that time also that they come for the same & they have not ask anything to me. Then next day I know from sources that they come for the insurance matter then I immidiatly inform to PSMD Mr. Mehta & Mrs. Chavvi Jain on 2/9 and also mail to both 5/9 . Both are saying that he will first definatly inform you for the reason & he visit in presence of authorised person. This matter is related to you & he ask all the thing to you & in presemce of you.

Mrs. Jain first told that I don't know that some person send to your office I ask the controler then next day I call her then she told me that he comes from the region. Mrs Chavi Jain told that we inform to the controler about that & let come the report then see.

Now what they want to do this & prove by this way.
