Re: Complaint against Kantilal Chhaganlal Securities Pvt. Ltd. for withholding my salary illegally for the month of September and October and terminated me from the organization under the advice of Mr. Amit Ajmera (Sr. VP. Operations, Mumbai) and Mr Amit Kumar More (AVP, Kolkata)
Very humbly, I Santosh Kumar Sharma joined the aforesaid organization on 24th July as Sr. Dealer at a fixed monthly remuneration of Rs.15000/- p.m. My said appointment was confirmed on the 18th September on basis of my good performance which has met the standards set by the organization. From then onwards I was supposed to be a confirmed employee of the said organization. My Job profile is punching trades which has instructed by the clients. I also have taken enough initiative to help my colleagues in Back Office Operations & other responsibilities given to me from time to time.
• Ever since I joined the organization there had been a series of terminations, withholding of salary. The organization strictly follows the policy of withholding the salary but I fail to understand the logic that barring the all India Heads sitting at Mumbai the Head Office, every employees salary can go on hold for any reasons at any given point of time. Here, I want to give some name of employees whose salary was on hold and then terminated from the organization, Mr. Manoj Agarwal, Mr. Satyaprakash Mishra and his team, Mrs Deepa Tandan, Ms. Puja Agarwal, Md. Arif, Mrs. Vaishali Gupta, Mr. Partha Mukherjee and now its me. This is always a communication gap between management and staff regarding policy matters and it leads to chaos environment
• All these anti employee rules and regulations are mainly formulated by previous management and now the present management followed the same rule. In the present management, Mr. Amit Ajmera (Sr. VP. Operations, Mumbai) and Mr. Amit Kumar More (AVP, Kolkata). These two guys are managing the entire activities at Kolkata Branch.
• First time when my salary was on in Feb’09’ then I talked with Mr. Vishal Goenka, CEO. So at that time he told me that Dealers has no revenue target and would be paid full salary. It was also mentioned in the MIS Sheet and Salary Payout Matrix structure which was prepared by management. But as per discussion with Mr. Vikash Kalani (Head, Sales & Retail), my salary had been reduced from Rs.15000/- pm to Rs.13000/- pm on account of downward market conditions. It was also assured that original salary will be restored on improvement of market conditions. I accepted in good faith and to establish my loyalty to serve the company for a very long tenure.
• But surprisingly in the October’2009’ it got reduced further without any prior intimation and gave me Rs.6400/- salary for the month of September ‘09’under the advice of Mr. Amit Ajmera (Sr. VP. Operations). As per the new salary payout matrix October which has been issued by Mr Amit Ajmera, there is mentioned that Dealers would be paid full salary. Therefore I send a mail to release my full salary but there was no specific reply for the sudden stoppage of my said salary. So if they followed the matrix rule then how can hold my salary.
• Sir, I am a direct paid employee of the company and not a contractual employee so why this kind of a rule should apply to held the salary. This was never mentioned in my appointment letter. If this was the clause of obtaining the salary then I would have never joined the company. I joined the organization with the pretext of a better growth in terms of everything at least that was promised to me.
• Actually the problem started when Mr. Amit Kumar More AVP, joined the Kolkata Branch Office from January ‘2009’. He put pressure on me to resign and threated me to terminate otherwise. It was his personal rigid stand as I never received any communication from the management HO, Mumbai. The situation further deepens when Mr. Vishal Goenka, CEO and Mr. Vikash Kalani, Head, Sales&Retail left the organization. Now, Mr. Amit Kumar More started putting in wrong and false information about me infront of Mumbai Office as he was now the sole authority and he was determined to remove me at any cost from the organization. To add to that my salary got withhold by Mr. Amit Ajmera under the advice of Mr. Amit Kumar More. Its also surprise that as a branch-in-charge Mr. More send mail to HO to restored his salary but not any other staff when the market conditions is improving. So you can understand how much he responsible for all.
• On the 9th November I wrote a mail to the Mr. Jayesh Sheth (CMD), Mr. Amit Ajmera (Sr. VP. Operations), Mr Savio D’souza (VP, HR) to release my salary for the month of October and all outstandings of previous months. Then In reply of the mail I got the termination letter with the immediate effect on 11th November’09’. This happened immediately after my confirmation on the bassis of my performance. If my salary has been put on hold then in that case Mr. Amit Ajmera’s and Mr Savio D’souza’s salary must have also gone on hold because they are also the paid employees of the organization. After my termination I send mail to the concern department at HO, Mumbai and also talked with Mr. Savio D’souza (VP, HR) but till date there is no any response from HO. This is a mental torture from the end of the management.
Therefore, I request you to take appropriate and prompt action against this illegal practice of Kantilal Chhaganlal Securities Pvt. Ltd. My career is at stake now because of aforesaid organization and two months without salary. I am passing through a very difficult situation because of sudden termination and unemployment.
