Sub: - Complaint against Manoj Singh Shekhawat (Relationship Manager) and Mr. Rajat Oberoi (HOD) officials of RetailMart.Com Online Comparison Shop (Linxsmart Technologies Pvt. Ltd.) which is a division Of Eperium Business Solutions India Pvt. Ltd. and Having it’s office at B-13, Sector-57, Noida01, India for fraud and cheating who in well planned conspiracy with each other have cheated me to the tune of Rs. 60, 000/- (Rupees Sixty thousands).
Sir,
With due respect, I wish to submit that I am Devendra Kumar Gupta s/o Raj Bahadur Gupta, R/o RZ-39, South Extn., Part-3, Dayalsar Road, Uttam Nagar, New Delhi-110059. The aforesaid persons have in well designed and preplanned manner have hatched a criminal conspiracy to cheat hard earned money to the tune of Rs. 60, 000/- (Rupees Sixty thousands). The brief facts of the complained disclosing the commission of the cognizable offence narrated below.
1- That I am residing at above address and the company RetailMart.Com Online Comparison Shop (Linxsmart Technologies Pvt. Ltd.), and having its office at B-13, Sector-57, Noida01, India. Manoj Singh Shekhawat (Relationship Manager) and Mr. Rajat Oberoi (HOD) are the employees/owners of this company. The said company is a division of Eperium Business Solutions India Pvt. Ltd.
2- In the end of April I received the call from the company customer care and one executive told me about the company business and scheme but at that time, I was not interested in the same. After few days again I received the call from the company customer care and after a long conversation between me and customer care executive, I agreed to meet company relationship manager. After that Manoj Singh Shekhawat approached me and came to my home and introduced him self as a relationship manager of the said company and he shown the booklet of the company, in which various plan were mentioned. He allured me to purchase the franchise of the company but I told him that I am not interested for the same. After that He also told me about the referral system/plan and assured me, he will give 3 referrals to the company under me and commission of referral will be pay to me with in 7 to 10 days. For the confirmation, he also sent the Email to his senior officer Mr. Rajat Oberoi about 3 referrals under me and copy of the same was also sent to me and also issued me a receipt with his signature on which he mentioned in on hand writing that “total amount will be revert back within 50-60 days and If any fraud found then whole amount will be revert". On insist of his, I agreed to purchase the plan of Rs. 60, 000/- (Sixty Thousands) and paid the money to them through my SBI Card.
3- After opening the franchise of the company, I never received any amount of referral commission or any commission/income of the advertisement, banners, sale and click charges etc. at my online store namely “www.devonlinestore.com” and I never received any copy of agreement from the company till now, As per commitment by relationship manager (Manoj Singh Shekhawat). About this thing, I did so many emails to Manoj Singh Shekhawat and Mr. Rajat Oberoi on many occasion but I did not get any reply from the said persons or the company.
4- After passing of committed time as per plan, I made number of visit and calls to the office of RetailMart.Com Online Comparison Shop (Linxsmart Technologies Pvt. Ltd.) and where officials present gave evasive replies and never told me where about Mr. Rajat Oberoi and Manoj Singh Shekhawat. The said person was never available in the office. Once after great efforts, one employee of the company on reception (Name not disclosed) assured me that my amount will be sent at my home through speed post or by hand but this thing also not completed till now and recently came to know in my knowledge that my all the password of my online store (www.devonlinestore.com) has been changed without my permission or without inform me. Regarding this I had sent an email but did not get any reply till now.
5- That I am a person of average income with limited means of earning, with this situation of misappropriation of my hard earned money, I am in a terrible financial problem which is also affecting my routine life.
6- In view of the aforesaid stated facts, it is therefore requested that FIR be register against the aforesaid persons/directors and owners of the company RetailMart.Com Online Comparison Shop (Linxsmart Technologies Pvt. Ltd.) who with dishonest intention allured me to invest my money with them on the false promises of good profits and cheated me causing wrongful loss to me and wrongful gain to themselves. I request you to take appropriate and strict action be taken against the fraud officially of the RetailMart.Com Online Comparison Shop (Linxsmart Technologies Pvt. Ltd.) and bring them to book in accordance with the law.
