Gratuity

Dear Sir,

I served above concern from 15th Dec to 24th Sep 2008 in Maintenance department. At that time my resignation letter was accepted and I was releived from my service from that concern. But they refused to pay my gratuity amount due to short of my service of 5 years. My service in that concern was 4 year and 9 months but on my releiving time they deduct my 3 month salary as a penalty, so by adding this as my service my service will be as 5 years. If they given my 3 month salary without fail I will not claim for gratuity fund. Because of this I lose my money in two way so, please kindly help me to get my gratuity or my penalty salary.
