Ticket not booked money deducted

Dear Sir

I made one ticked from Delhi to Mumbai journey date 16/06 in tatkal, but ticket was not booked and money deducted from my account why the money is deducted when the ticket was not book who will pay the penalty for this, today i have booked the ticked, bank deducted the booking charges also which was not refundable, it happens so many times is there any legal action to take, or who should pay the penalty, please do the needful..
