A sub-standard product

I, Prof Singh, purchased black colour New Activa DLX from Swarup Motors Pvt Ltd Vikas Marg, Delhi 110092 Phone 2010710-11-12 on 31-1, Frame No: ME4JC448AB8045238, Engine No. JC44E1156153,

Exide Battery 15-12-10A7, Registration No. DL7SBF9589

At the time of third service at Singh Autos, GT Road, Ryya (Amritsar), Ph01853-657157, Job Card No.8642, it was revealed that the its battery is dead. At that time neither the horn was working nor the self-start system. It means within a period of eight-month the battery worth 1400/- is gone. The battery was removed for recharge and kept for three days. Now without battery, neither there is self start system, nor indicators and horn system work, meaning thereby that the product is not at all useable. If the battery is taken out, the rest of the product is just a normal two wheeler. The other two wheelers may be batter, because without battery, their indicators, their horn and light work. However, there is no inbuilt system with which all systems work excepting, self start. It means that the most important part of this Honda Scooter is Battery and without battery all claims of Honda are shattered and the product is not at all useable on the road.

Let me now talk about the battery which is of reputed brand but sub-standard. My survey at the above mentioned service station is that 80 per cent of of activa, and other products of Honda using battery whether they came there on Sept 1 and many more came during my stay of four hours relating to my activa service were having battery failures.

One cannot say that Activa is an excellent product but the Exide Battery is defective. I had been dealing at the Indian Institute of Foreign Trade, New Delhi with the liability problems at the class room level. And there as per the Consumer Protection Act, or European Directive on product Liability, 1985 and for that matter the Japanes Liability Law, Activa Scooter and Excide Battery is a single product which the consumer Purchases. As per the Implied Warranty, the product must be durable, safe for the safe use of the consumer or user and must be fit for the purpose for which it is manufactured and placed on the market. Therefore, it very much comes under the liability laws.

A 68-year old person had purchased the above product based on the claims made by the Company which come uder Express Warranty of the Liability L: aws However, failure of the battery has shattered all my hopes and aspirations about this Product.

The battery was charged and placed in my scooter. It still does not work properly. It appears there is no automatic system placed in the scooter which charges the battery. Afterall what is the life of a battery. Only eight months.

Please investigate the Excide Batteries suppolied which appear to be substand ard may mar the future market of Honda Products. Secondly, What should I do with the battery. I asked the service centre to replace it. There was no clearcut answer from them. I have doubts that they always recharge during warranty period, and may be taking from Honda its replacement. This case is in point and the Honda may like to make a check on this service centre and if they say that they have replaced the battery, then the Honda may ask for the original battery which should be with them. The number of the new battery is given above. The question which further agitates my mind is that what will happen after the warranty period.
