Sub:- Rejoinder to your letter dt.06-10
We deny every allegation made by you in the above dated letter. We herewith reminding you point by point the following.
1. As earlier we told to you, since our area is very vast area covering from Vijayawada to Chirala, we requested your area manager and with his oral instructions and your oral permission (may we recall you the situation when we standing out side of your room in Swarna palace, Vijayawada where the a/c.s meeting was held, that time we i.e my self and Mr. Ganesh, your Guntur a/c., asked to give an ad in The Hindu and then you commented that advertisements will not give any business, any way try your best! these words were been told by you only) and then we (i.e My self and your Guntur a/c. ) have given the advertisement in ‘THE HINDU’ and the copy of the said advertisement sent to you along with a covering letter, If we have any bad intentions we would have not sent it to you. Last year also we have given the ad. that time you have not opened your mouth. Any way for unknown reasons you asked orally to us, (afterwards we received your mail and letter) to stop that ad. and without saying a single word we obeyed and stopped it. After that we have never given any ad. If you are really concern about this why you were mum when we issue 1st ad. And why did you continue doing business with us, why did you accept our orders?
2. We have not collected single paisa in advance as the schools managements are refused to pay in advance either by way of DD or Cheque since they have had bad experiences with some companies and immediately we bring this issue to you and your area manager Mr. Jiji Kumar’s notice in very first year and we got yours and Mr. Jijikumar ’s oral permission to put our money in advance to get books and other material as you do not extend any credit. So after sending the DDs only you released the material and we distributed the material to various schools and we collected our money. This is VERY KNOWN TO YOU ALSO and now you are acting very smartly that you do not know any thing. It is very clear that we have not collected single paisa in advance, more over your staff requested us several times to collect the money for question papers etc., and this issue we have informed to you in the e-mail dated Nov.24 at 4.58 p.m. As said in that e-mail we clearly wrote in a polite way that we are fed-up with your treatment and negative attitude, we are ready to give up the agency, in turn you replied in a tricky way that you are worrying about our money and our future but not readied to give up us, because it is very hard to find another innocent. We send the DDs from one bank and from our office address, if you have objections you might have rejected the DDs and order letters, so this it self clearly indicates that all of you are well aware that we sent the money in advance on behalf of the schools as they denied to pay in advance to a unknown company in our area and they expressed doubts that “what if the company does not send the material after realization of the payments? “ So we take DDs in advance on behalf of schools and this has been informed and got oral permission from you and your area manager Mr. Jiikumar.
3. We went to Kavali as they are known persons to us and we went there, after informing to Mr. Jijikumar and actually we redirected them to your head
office, even though we signed the LOI and colleted Rs.1000/- and that time you
purposefully shouted on me and asked us to give the cheque back to the school.we
have never gone to any school out of our territory, if at all we went to any
school in and around Vijayawada (i.e Kondapalli, Tadepalle, Guntupalli etc., )
with your permission only and for that we gave you a mail seeking your
permission on Apr 14 at 11.40 am. But you encouraged your pet
Academic consultant to intrude our allotted area i.e M/s. Ravindra Bharati School,
Vijayawada.-9.
4. We never deviated the guidelines of you or we never shouted your people,
Moreover your people and your self insulted us several times.
a. Just recall the situation when we were giving a Demo at M/s. Montissori school, Tenali when the Principal asked you that “ who is the responsible person in our area? Immediately you answered him in a loud voice ‘NO THIS PERSON IS NOT RESPONCIBLE AND NOT EVEN A POSTMAN AND HE IS JUST LIKE MESENGER’.!!! After hearing your answer principal fell in shock and suspected us and we were too in shock, though we have high reputation in Tenali area and he simply refused to give the order because of your behavior.
b. Your people sent wrong dispatch of the question papers, the bundle has damaged so the post office people asked whether you take delivery or send back the material! so to avoid all headaches by returning the goods etc., I personally went to post office and called Ms.bhanu and asked her what is the material you sent, to cross check the bundle which was in open condition, since it is very easy to find out from the sending source, unfortunately she shouted on us like any thing and moreover she commented on me personally that this is not the way to do business etc., so that is the reward we got for extending personal help. Immediately I tried to contact you to convey this but you did not lift the phone so immediacy I narrated entire episode to Mr. Jijikumar and he also felt bad and assured by saying us that this is very irresponsible and reckless behavior of her and this will not happen again. I can say so many humiliations made by you and your people but we never reacted in negative way.
c. Though Your Point 1 is clarified in the above paragraphs, we want to say one thing regarding end of 3rd line of 5th paragraph you used the word that we have stolen the hard work of others. It is totally baseless and infact you have stolen our two years of hard work and your behavior damaged our reputation in our area.
d. Even though we have been appointed as academic consultant in Vijayawada -9, you are illegally allowed to another academic consultant to take the order from M/s. Ravindra Bharati School which is our area. For your personal interest, you and the said academic consultant made un ethical agreement and taken the order, it has been allotted for us, we used to visits the above school (we sent visiting reports also, please check your data), you purposefully ignored our hard work there and you take his side. This is purely stealing of one’s hard work.
e. In M/s. Aravinda School, Mangalagiri/Kunchanapalli issue, we have taken two years time to enter in that school, (even Mr. Jijikumar also aware of that and we’ve visited this school several times, if want you can check your data sheet and visiting reports) we signed the LOI and collected Rs.1000/- cheque and informed you. After 2 hours you called us and asked to give back the cheque to the school and simply you allotted the school to your favorite academic consultant (again he!!!) showing some false technical reasons. This is also purely stealing of one’s hard work.
f. You wrongly complained on us that we have taken the orders from the area which is not allotted to us. If you found that the coming orders are from the other area and not from area, then you should have returned the orders stating that ‘this area is not belongs to your area so we will not send the material’ or you may inform us by saying that “you will get less commission”. But You never done like this and taken the orders along with DDs in advance and executed the order, so this is also an act of cheat played by you to avoid full commission to us.
5. As you highlighted the issue of violating the financial matters: It is cleared in above 2 nd paragraph. However again we are clarifying the 3 rd paragraph of Your point Number 2, you are emotionally blackmailed us and to put sign on the papers even without looking at them, actually that time we are in hurry to catch our train to comeback Tenali, do you remember that? When I asked you what are these papers you and Mr. Jijikumar told that nothing is there, those papers are simply minutes. Actually you called me to Chennai to solve the problem of intrusions done by your favorite academic consultant but off late we came to know (after reading the subsequent mails and tele talks) that we were been deceived.
6. Giving of No Dues certificate: It is meaning less and ridicules also and one way cheating us, we extended credit to schools on your recommendation so we have to give no dues certificate to schools but in reverse you are asking the same.!? there is no advance collection of money or any thing from schools so there is no need of getting No dues certificate from the school. If you want you can give a paper advertisement stating of our withdrawal of our association with you and you have not mentioned in your mail that we have to produce no dues certificate either in agreement or your earlier mail dated Sep 19. We extended the financial help to the various schools within our territory enabling them to purchase your books. We invested the same purely out of our pocket that too following and obilizing your advise and suggestion in part of promoting business of M/s. Compugen. So you have no right to give wrong direction to the schools not to pay the amount invested by us. You are nothing to do with the said money more over you are also responsible in one way or other to see for that the schools shall pay the money to us which was invested.
7. After taking decision of quitting your agency on 18th sep. we requested you and your area manager Mr. Jijikumar over phone to give us 45 days time to collect our dues from various schools, your Area Manager Mr. Jijikumar agreed orally to extend 45 days grace period stating that you have given permission to do so and even we put a request mail to Mr. Jijikumar to extend help to collect our dues, mail date is sep 21 st 2009 and he purposefully not replied that mail. for your information you can hear his recorded voice which is enclosed in this mail and CD format in Registered post. And we asked Mr. Jijikumar to take the all CDs and all miscellaneous material, he only told that he will collect the material afterwards. In respect of his oral commitment of 45 days grace period we are replying you after the grace period i.e today the 2nd of November.
8. We never denied your or your persons phone calls, we received either phone calls or e-mails very politely and replied immediately, if want you can check the mails. So your allegation of Your point Number 4 is false and fabricated. You only shouted on us and our employees with high pitch of voice and very abusive language and writes all negative and lengthy mails and you degraded us in the letters dt. 7-10 written to various schools informing the termination of association
9. From the first year beginning onwards your basic intension was cheating, that’s why you have not sent any account copy to us even though we requested for the same so many times over phone and mails. Now clearly showing your intentions of cheating us, from one side you played a drama through Mr. Jijikumar, that you have given ample time to collect our money and other side you are informing the schools through phone calls to not give our amount, this is showing your intention of cheating and your, your’s area manager Mr. Jijikumar actions are liable to put a cheating case against you both. Even in your letter dated 06-10 admitted that the termination letter been preparing by the date of receiving of legal notice Dt.26-09 so it is very clearly showing your double play. We are suspecting you that you are doing all this to evade our commissions and deposits with you. You wrote letters to all schools about our discard, again this is violation of your oral commitment to not intimate the schools for 45 days (your area manager oral commitment on 19th of September has been recorded and attaching with this mail) and this action results us a very huge loss.
10. Your action towards our attender Mr. Nagamalleswara during your last visit to Tenali on June 19th Morning 9.30 am is very very objectionable, for only reason of spilling of water by mistake on you, you cursed him lot by saying ‘that you SC/ST people like this only’ and you slapped him, though he said sorry to you, at that time our attender thought of putting SC/ST atrocity case on you, we consoled him by looking at the goodwill of Brilliant Tutorials . after some time you realized and promised us to give him written apology letter but till now he didn’t get it. So you have to send written apology letter to our attender Mr. Nagamalleswara immediately other vise we are not responsible for the action he would be taken.
11. We have faced lot of problems with you since the beginning. Your people sent so many wrong dispatches to wrong address, as a responsible person in our area we collected the wrong dispatched material from schools and send them back to you for getting right material from you with our own cost, in this process we incurred loss of so many man days and money. With your aggressive and bullying nature we experience so much mental agony which is irreparable. Till we do the business with you because of the great good will of M/.s brilliant tutorials and several requests made by your area manager, but you used to write mails that we have done mistakes, this is all to safe guard your mistakes.
Conclusion:
Though your intentions are very bad and bias towards one or two academic consultants for your personal benefits, even today also we want to quit this agency in peaceful way and we are not asking you any favor but our hard earned money, this is clearly mentioned in the mail sent to your area manager Mr. Jijikumar dt., sep 21st 2009. (mail copy enclosed)
a. We have already requested you to settle our amount on 5th august at 11.31 am itself through e-mail (copy of the mail enclosed) and again we requested you on sep 18 at 2.51 pm by e-mail (copy of the mail enclosed) but you have not settled the account.
b. May I ask you one question? When our requests are very clear and there are no dues from our side why you have stopped our payments? And What is your intention? Why you are hesitating to send the account copies from the beginning of our association? You have sent a mail quoting Srinivasa Rao, ICICI Cheque no. 032197 for Rs. 1, 80, 448/-, Latha, ICICI Cheque no. 032205 for Rs. 51, 457/- on Sep 19 Why you have not sent the cheques so far?
c. As we clearly expressed our desire to discontinue of consultancy vide our reply mail dated 19th September (you also agreed this in your letter dated 6-10, point number 4, 2nd paragraph 4th lane) and we asked your area manager take all the books and remain promotional material (but your area manager only refused to take the material as they are bulk to carry and requested us to retain the same for some more time) since your both the demands for releasing our commission i.e giving the letter of discontinue and material fulfilled, why you did not send our commission? why you have break your promise to send the cheques immediately after my hearing of willingness of discontinue and returning the material to your area manager as you stated in the mail dt.18th September at 8.37 p.m in point 5 a. 1st 2 lines . what is your intention to send the termination letter? Is it for evasion of our deposits?
d. We have created an awareness and market for your product by visiting frequently to schools, spent lot of valuable time and money by me and our staff M/s. Venkat Rao, Ramakrishna, Anusha and Sri Devi for that you are giving reward like this?
e. If you ask straight away that you want to appoint your pet academic consultant for Vijayawada and other our areas, we would have been give-up our agency with pleasure, no need to play this high drama.
f. As a last try we contacted your Principal office on 11th September and wrote a request letter dated on 13th September and 23rd of September and also spoke with your Area Manager Mr. Jiji Kumar to settle down the issue in a smooth way on 15-10 at around 2 p.m, he promised to call us but till date he did not turned up.
g. So we decided that we have to take legal steps to go forward to safeguard our money and our honor.
h. If you are failed to do justice for us, we have to take further steps legally to safe guard our hard earned money and our reputation and you have to bear the all legal expenditure and we have right to collect our money with interest @24% p.a.. from the date of 5th August.
i. We came to know that you have cheated so many people in our area by promising agency for them and collected money and afterwards you denied them to give agency showing some tricky reasons and not paid back their advances, we will take their help also legally to get our money.
j. Any way we and our staff want to forget all this as a nightmare and want to do our routine business, we request you once again (this could be the last one) to settle our account immediately or within 7 (seven) days of receiving this letter other vise you are only responsible for the legal consequences and all expenditure, we herewith sending the remained promotional material including Compugen books and demo CDs through M/s. Navata Transport, T.Nagar, Chennai and LR No. is sent to your Head Office, T.Nagar, Chennai. Even at this stage also we are ready to talk with you to solve the problem in a decent manner.

We are requesting you Madam/Sir kindly enquire with all old and with existing consultants about Mr. Viswanathan treatment and harsh behavior, just think logically, why consultants are been changing every year except Machilipatnam town? People are taking consultancy because of goodwill of Ms/. Brilliant Tutorials but not because of this person. This person is spoiling your goodwill by his aggressive and negative behavior with all academic consultants.
We request you to do justice to us and take suitable action on Mr. Viswanathan.
