Sir, I want to know whether there is any rule stating that the employee needs to give 3 months prior notice before leaving the organisation (ON MEDICAL GROUND), also during the summer vacation without taking the salary, can an employee submit the resignation letter and request to relive from service.
Details: Sir I have worked for the stated private college for around 2 and half years, before I had been diagnosed with acute lungs disorder. I had no time to go to hospital for detail diagnosis during the working days, hence I decided to undergo detail check during the summer holidays itself, where i learnt about my medical condition, also as had difficulties in taking the classes (before the point of deciding to quit the organisation) I was advised to take rest for 2-3months, and hence i submitted my resignation during the middle of my summer vacation. Now when I have decided to quit the organisation the management has demanded to return to me 3 months salary (all DA HRA Basic). Sir please suggest me any measure i could take to come out of this situation on legal basis.
