Cheating and Breach of Trust by LG Dealer Anil Electronics at Agra

Dear Sir,

I purchased 42" LCD TV Model No. 42LK430 along with 2.0 Ton Split AC and a Home Theatre from LG dealer in Agra M/s Anil Electronics, Opp. Kargil Petrol Pump, Sikandra Bodla Road, Agra, vide Challan No. 328 Book No. 07 dated 18/05. The Goods were part financed by Bajaj Finance. After realizing full payment on 18/05 the Dealer is not able to provide the LCD & Split AC till date. I went thrice to his shop all the way from Mathura Refinery Township, Mathura, to collect Goods but he couldn’t provide all the goods.

At first, on 18/05, after waiting whole day long, the Dealer called me to his shop and tried to make fool of me by offering a Demo Piece. And the set being offered was in old & used condition and very clumsily packed which I out rightly rejected as he was supposed to provide the LCD in Factory sealed condition.

On 19/05 he tried to convince me to receive the same Demo Set or else another model 42LK450 but I didn’t. He then told me that the Brand new set is lying in his Go-down so I would have to wait for 2-3 Hours. I waited whole day long, but he didn’t bother to arrange the set. Finally, I came back to Mathura without receiving any goods. I planned to send all the goods in one mini Truck or a Van costing around Rs.500/- so I dropped the idea to pick up the Split AC separately though Split AC was available at the shop. I told the Dealer that it was his fault so he should arrange to send the material at his cost.

Once again, on 21/05 at 11.00 Hrs, the Dealer promised me to provide Brand new LCD (Model 42LK430) in Factory sealed condition and told me to come from Mathura and collect the Goods from his Shop. When I arrived at his Shop, I couldn’t find my ordered LCD. The Dealer told me that LCD is on the way and the Bearer has stuck up somewhere in traffic jam. I waited for hours but nobody turned up. The Dealer, it seems, was telling a lie. I could read the faces of other salespersons who were present there, too Then I left his Shop telling the Dealer to call me if the set arrives. I received no calls from him. Finally I talked to him at 19:00 Hrs and the Dealer showed his inability to provide the LCD Set that I purchased from him citing the reason that the 42LK430 LCD is in short supply from LG Company but he will, somehow, arrange the Set in day or two. I could not pick up the Split AC on that day too. But the Dealer confirmed that he would send the materials at his cost.

By far, it was evident that the Dealer was taking me for a ride and had committed a breach of trust by selling and receiving payment against the LCD Set that he was actually not having in his stock. How can he sell and receive full payment against something that he cannot provide. It is a cash market. He tried many times to influence me to receive the Demo Piece. In fact, now, when I recall, the Dealer has a history of selling those Demo pieces. Just one month back, I purchased a 32” LCD (Model: 32LD460) which he told was in Factory sealed condition. But when I took it to my home, I found that it was opened from the bottom and packed with cello tape in such a manner that I couldn’t judge the condition of the set immediately trusting the Dealer. Considering it my mistake, I only informed the Dealer about the open condition of the set and asked him to curb this practice. In late Nineties also, I purchased an AIWA Music system (Cost: Rs. 27000/- at that time) to give as a gift to my brother, from the same Dealer. That piece was also a Demo piece that the Dealer realized later when the matter was referred to Consumer Court. I still have those documents with me.

After waiting for 2-3 days of the purchase, I registered a complaint with Customer Care (Ref. No. RNA 110522027435) and they advised me to talk to Mr. Rakesh - Area Sales Manager. He assured me to resolve the matter at the earliest. Upon enquiry he found that he would not be able to arrange the Set before Friday, 27/05. On 23/05 when I asked Mr. Rakesh to instruct the Dealer to at least send the Split AC which is readily available, he assured me that he would look into the matter. I have received only plain assurances, by far, but no concrete action is being taken against the Dealer who is cheating innocent customers in broad day light. On 24/05 I brought this matter to the Ms. Ratika Bhardwaj, CCO, LG Electronics India and she assured me that at least Split AC will be delivered by the Dealer on 25/05 obviously at Dealer’s cost.

I request Consumer Complaints Forum People to resolve this issue and take strict action against the erring Dealer who is cheating innocent customer and causing loss of reputation to such a good company.
