Issues On The Very First Day!!!

I purchased LG Optimus One P500 from www.letsbuy.com on 02-09 for Rs. 8999/-. It was delivered at my doorstep by Bluedart on 05-09. The only issue with the phone was that you cannot hear any sound out of it. Eg. You cannot hear the other person on the phone however they can hear you. Also you cannot hear the songs played on the player of the phone. Tried the volume rocker and it was turned to full. The phone's profile was also set to normal. Also tried using the headphones but to no avail.

I called LG Mobile's customer care and spoke with a representative named Sayed. He asked me to visit Ekadant Corporation which is situated in Thane. The representative over there Ms. Poonam was about to send it for repairs. I pointed out that the phone is very well under replacement warranty as it's not even 7 days old. It was unpacked hardly an hour ago. She said that they would need seek an approval from the company for a replacement and if approved it might take 7 days for me to get a cell. When I sought to escalate the issue she asked me to speak with Rajib Shah (cell #s 98190 57833 and 93239 0403). I spoke with Mr. Shah who said if its the software issue then the cell would not be replaced but the software would be upgraded. I said very well. He spoke with Poonam and asked her to update the software since the OS version on it was Android Froyo 2.2.2. She asked me to wait till the software was upgraded. After waiting for 30 mins I asked her the status and she said that the software was up to date. I said it was not. Asked her to check it again, she did and agreed that it had Froyo. She then said that she will have it checked the next day and get back to me in the evening.

What kind of a ridiculous service is this? I have worked for a cellphone company with the services and I am well aware of the replacement clause under DOA. If the phone is not working there is no argument and a fresh set is given as replacement. I have never seen any company making a consumer wait for 7 days before actually giving them a replacement.

I am seriously considering my option of approaching the consumer court. Is LG listening to this??
