This is with ref. to my complaint i posted on November, 07 with regard to the purchase of ORION MOBILE and POORVIKA MOBILES PVT LTD., TUTICORIN. After purusing with POORVIKA AND ORION finally they have given a new mobile on Nov, 10 in lieu of defective mobile. Again the new mobile could not be charged. The details of exchanged new ORION PHONE is

DEFETIVE MOBILE

Sir,

I purchased Orion Mobile 905 model from POORVIKA MOBILES PVT LTD., from TUTICORIN, INDIA (THEIR CELL NO :9600042855) vide Invoice No:1617 dt 14-10 at the basic price of INDIAN RUPEE 2403.00 excluding VAT @4% and Insurance of Rs 100/-.TOTAL Price was Rs 2600.00

BATTERY NO: YT10060000014.

On 30-10, when i charged the cellphone, it is indicated in the cell phone as " BAD CONTACT OF CHARGER " and as a result I could not charge my cell phone. When i charged again and again, the same problem occured. Immediately i rushed to the POORVIKA MOBILS SHOP at the same place TUTICORIN on 30-10 evening, the sales men put another battery of the same model of ORION and asked me to charge at home for 8 hours and also further said that there would not be any problems. When i charged the mobile on 30-10 night with the different replacement of the battery of the same model, again in the cell phone it is indicated that"BAD CONTACT OF CHARGER " Low Battery - Shutdown.

On 31-10 morning at 9.00 clock agian, i approached the POORVIKA MOBILE SHOP at TUTICORIN with my cell phone and charger and asked them to provide me a new phone as the cell phone failed to

satify the warrenty conditions within 15 days of my purchase. Instead of giving a new phone, they tried to test the cell phone with my charger. They further tested it and found that the mobile could not be charged and as a result they informed me that the mobile reqires some repairing and to be sent to service. Further they said me to come over on 02-11 to collect the repaired mobile. When i contacted the shop i.e on 02-11, they told that your mobile is not ready and has been sent to CHENNAI for repairing.

On 06-11 i went to the shop. They informed me that the mobile could not be repaired and futher they insisted me that POORVIKA MOBILS SHOP is not responsible for any defect in the mobile and it is the responsibility of the respective maufacturer to repair the mobile and not POORVIKA.. Further they asked me to come over after 2 days to get it again repaired.

In this connection, i have following objections:-

1) I purchased a new orion mobile on 14-10 i.e just 15 days back. The mobile could not be charged wihin 10 -15 days of purchases is obiviously due to the reason of the manufacturing defect only. Hence,

i need a replacement of a new orion phone or otherwise my money to be refunded.

2) The reason for sending my phone to service centre for repairing is not acceptable to me as i am not havivg a old ORION mobile. It so suspects their testing clearence of mobile they handled and requires serious review.

3) Now only i have come to the notice that seller POORVIKA MOBILE SHOP at TUTICORIN is not responsible for the defect in the mobile and the reponsibility lies wholly with the maufaturer. It is against the law and ethics.

4) As a buyer i signed in the invoice as a token of the receipt of the mobile only. If something is written in the invoices just above within braket that the POORVIKA mobile is not responsible for the defet in the mobile does not bind me.

5) If seller is not responsible to the buyer then there is no contract of sales and in that event they should not only replace the new phone but also equally compensate me for giving a defective new phone and the metal agony i got.
